Talk2Me USA Inc provides communication equipment, software, programming services, and related products that may be capable of operating on various radio frequency bands, including but not limited to UHF, VHF, 700/800 MHz, GMRS, Amateur Radio (Ham Radio), Business/Industrial Land Mobile Radio, Marine, MURS, and other authorized radio services.

The purchaser, owner, licensee, and operator of any radio equipment sold, programmed, or serviced by Talk2Me USA Inc is solely responsible for ensuring compliance with all applicable federal, state, local, and international laws, regulations, licensing requirements, and operating restrictions.

Licensing Requirements

Many radio frequencies require authorization from the Federal Communications Commission (FCC) or another applicable regulatory authority prior to operation. Users are responsible for obtaining and maintaining any licenses, authorizations, or permissions required for lawful operation.

Talk2Me USA Inc does not grant, assign, transfer, lease, or imply any authorization to operate on licensed frequencies through the sale, programming, configuration, or delivery of radio equipment.

Amateur Radio (Ham Radio) Disclaimer

Operation on Amateur Radio Service frequencies requires a valid FCC Amateur Radio Operator License of the appropriate class. Users must comply with all FCC Part 97 regulations and are responsible for ensuring lawful operation within authorized amateur radio bands.

Talk2Me USA Inc does not verify amateur radio licensing status and assumes no responsibility for unauthorized operation on amateur radio frequencies.

GMRS Disclaimer

Operation on General Mobile Radio Service (GMRS) frequencies requires a valid FCC GMRS license unless otherwise permitted by applicable regulations.

Users are solely responsible for obtaining and maintaining any required GMRS authorization and for operating within applicable FCC Part 95 regulations.

Business & Industrial Frequencies

Operation on Business and Industrial Land Mobile Radio frequencies generally requires a valid FCC license issued to the organization or entity authorized to use those frequencies.

Customers requesting radio programming for business frequencies represent and warrant that they possess the legal authority to utilize the requested frequencies.

Public Safety Frequencies

Talk2Me USA Inc will not knowingly authorize, endorse, or facilitate unauthorized operation on public safety frequencies assigned to law enforcement, fire departments, emergency medical services, emergency management agencies, government entities, or other protected services.

Customers requesting programming of public safety frequencies represent and warrant that they possess all required authorizations and approvals.

Unauthorized operation on public safety frequencies may result in substantial civil penalties, criminal prosecution, equipment seizure, and other enforcement actions.

Frequency Programming Requests

Talk2Me USA Inc reserves the right to refuse any programming request that:

• Appears to violate FCC regulations.
• Involves unauthorized use of licensed frequencies.
• May cause harmful interference.
• Involves public safety or government frequencies without appropriate documentation.
• Presents a potential legal, regulatory, or safety concern.

Customers may be required to provide copies of FCC licenses, letters of authorization, frequency coordination documents, or other supporting documentation before programming services are performed.

Interference Disclaimer

Radio communications are inherently subject to interference, congestion, propagation conditions, equipment limitations, atmospheric conditions, network outages, and other factors beyond the control of Talk2Me USA Inc.

Talk2Me USA Inc makes no guarantee regarding:

• Continuous availability of radio communications.
• Coverage or signal quality.
• Interference-free operation.
• Compatibility with third-party systems.
• Performance on specific frequencies or geographic locations.

Users assume all risks associated with radio communications.

PoC (Push-to-Talk Over Cellular) Services

Push-to-Talk Over Cellular (PoC) devices utilize commercial cellular and internet networks operated by third-party carriers and infrastructure providers.

Coverage, availability, performance, latency, and service continuity are dependent upon third-party network operators and are not guaranteed by Talk2Me USA Inc.

Temporary or extended service interruptions may occur due to carrier outages, network maintenance, infrastructure failures, acts of nature, cyber incidents, government actions, or other circumstances beyond our control.

Customer Responsibility

By purchasing, possessing, programming, leasing, reselling, or operating equipment supplied by Talk2Me USA Inc, the customer acknowledges and agrees that:

• They are solely responsible for lawful operation of the equipment.
• They will comply with all applicable FCC regulations.
• They will obtain all required licenses and authorizations.
• They will not transmit on frequencies for which they lack authorization.
• They assume all responsibility for the use of programmed frequencies.
• They will indemnify and hold harmless Talk2Me USA Inc from any claims, fines, penalties, damages, losses, or expenses arising from unlawful operation or misuse of radio equipment.

Limitation of Liability

To the maximum extent permitted by law, Talk2Me USA Inc shall not be liable for:

• FCC enforcement actions.
• Regulatory fines or penalties.
• Frequency interference claims.
• Loss of communications.
• Business interruption.
• Property damage.
• Personal injury.
• Consequential, incidental, indirect, special, or punitive damages arising from the use or misuse of any radio equipment, programming services, frequencies, or communications systems.
